To me, that sounds like a death sacred to Odin, because I associate Odin with oak trees, although I've got a vague tickle in the back of my brain that there is a Celtic precident for this, as well.
But assuming that it IS a death sacred to Odin, I see some problems. The first is that the blood-eagle is more appropriate.
And the second is that Tyr is more relevant to actual codes of law. Odin is more about, y'know, being ABOVE the law. Loki is about ignoring the law, Tyr is about following the law, and Odin is about knowing the law but doing what you feel is necessary whatever its legality.
So I'd suspect that, no, you wouldn't beat the rap on religious grounds, but that there is a chance that you nonetheless ought to do it, and suck up the consequences.
I have to admit I'm not that familiar with Canadian law regarding religious freedom. It would never work in the US - they don't even let their favored religion kill people over beliefs.

Wouldn't it be fair to know what they actually did first, before you decide on a hypothetical sentance? I mean, I don't think the wise ass plastic mall pagans in Markham who condecended to people for not knowing how to pronounce a God or Goddesses name deserve that. Now, if the person in question is that Kevin Carlyon dude, who calls himself the "King of the British White Witches" who runs around in a bathrobe and whores to publicity, that would be understanding.
